These general terms and conditions of sale apply to all sales concluded through the website https://dakimakura.store/.

ARTICLE 2: ORDERS

The automatic recording systems shall be considered as proof of the nature and content of the order. Dakimakura Store® confirms the acceptance of the order to the customer via the email address provided by the customer. The sale will be concluded upon Dakimakura Store®'s validation of the payment for the order, which means the date of payment validation for orders paid online by credit card or the date of receipt of the payment by check. Dakimakura Store® reserves the right to refuse or cancel any order from a customer with whom there is a dispute regarding the payment of a previous order.

ARTICLE 3: AVAILABILITY OF ITEMS

As long as our offers and their prices are visible on the website, they are valid. The availability indicated at the time of consultation on the website by the customer is subject to the stock status at Dakimakura Store® and, of course, with the suppliers.

To create our storefront and sales catalog, we work with databases enriched based on information provided by our suppliers. This database contains over a hundred items, not all of which are physically stored in our inventory. Our offer is subject to the availability of items from the suppliers.

Only the permanent discontinuation of an item by our suppliers results in its removal from our sales offer. In other cases, a new order within a specified timeframe remains possible.

When a product that has been ordered becomes unavailable, the customer is informed via email or on the invoice of the products shipped in the case of a multi-item order.

Deadline for order delivery: When placing the order and on the order confirmation, a delivery time is communicated to the customers. It is calculated by adding the longest product availability period to the transit time of the chosen transportation mode selected by the customer.

From the moment the order is placed until its shipment, the customer has the option to cancel their order.

ARTICLE 4 : PRICE

The prices indicated in euros are considered final, excluding shipping costs. This price includes the cost of the products, handling, packaging, and product preservation. Prices are subject to change at any time without prior notice, and items will be invoiced based on the prevailing rates at the time of order registration. All orders are invoiced and payable in euros. Any potential customs fees or local taxes are the responsibility of the recipient.

ARTICLE 5: SHIPPING COSTS

Shipping costs include a contribution to the preparation, packaging, and postage expenses. Please consider consolidating all your items in a single order. We cannot combine two separate orders, and shipping costs will be charged for each of them.

ARTICLE 7: DELIVERY

We deliver to your home or to a pickup point. The delivery time includes the package preparation time plus the transit time. Dakimakura Store® delivers worldwide. The buyer will be notified by email of the different stages of order tracking: the preparation stage and the delivery stage.

The delivery time includes the preparation time and the delivery provided by our carrier. The announced delivery time of 10 to 20 days is valid from the moment the buyer receives the delivery confirmation email. The delivery time of (as announced by the carrier) does not commit Dakimakura Store® to a longer timeframe.

ARTICLE 8: WARRANTY - RETURNS - REFUNDS - WITHDRAWAL

The items supplied by https://dakimakura.store/ are new and guaranteed against any defects. They are identical to those found in traditional retail and come from all the publishers and suppliers referenced.

If an item happens to be defective or non-compliant, the buyer has 15 business days from the receipt of the items to request an exchange or a refund. If the fifteen (15) days deadline falls on a Saturday, Sunday, or a public holiday, it is extended until the next business day.

The customer must return new or unused items in their entirety and in their original packaging, intact, along with all potential accessories, user manuals, and documentation (in its original cellophane packaging and with the corresponding invoice). In such a situation, the buyer must send proof of the defect(s) to contact@dakimakura.store (description and attached photos).

In the event of exercising the right of withdrawal, Dakimakura Store® is obligated to reimburse the amounts paid by the customer, without any charges except for the return costs. The refund is due within a maximum period of 14 business days from the date of receipt of the returned package(s).

Yes, the return shipping costs remain at your expense.

In case of a refund, we guarantee that it will be processed within 14 days from the date of receiving the returned package. We do not accept any shipments with cash on delivery, regardless of the reason.

ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS

The transfer of ownership of the products to the buyer will only occur after full payment of the price by the buyer, regardless of the delivery date of the said products. However, the transfer of the risks of loss and deterioration of the products will occur upon delivery and receipt of the said products by the buyer.

Dakimakura Store® is the producer and owner of all or part of the databases comprising this website. By accessing this website, the customer acknowledges that the data it contains are legally protected and undertakes not to extract, reuse, store, reproduce, represent, or retain, directly or indirectly, on any type of medium, by any means, and in any form whatsoever, any qualitatively or quantitatively substantial part of the content of the databases displayed on the accessed site.

ARTICLE 11: LIABILITY

Dakimakura Store® is not responsible for the content of the works and cannot be held liable towards the buyer. Dakimakura Store®'s liability cannot be sought in the event of force majeure (strike, flood, fire...).

Dakimakura Store® declines all responsibility if the delivered item does not comply with the legislation of the delivery country (censorship, prohibition of a title or author...). Dakimakura Store® is not responsible for the content of websites to which hypertext links may refer from its own site.

ARTICLE 12: APPLICABLE LAW

All the clauses contained in these general terms and conditions of sale, as well as all the purchase and sale transactions referred to therein, shall be subject to Belgian law.

ARTICLE 13: BUYER'S ACCEPTANCE

The buyer expressly agrees and accepts these general terms and conditions of sale, as well as the prices, and declares to have full knowledge of them, thereby waiving any contradictory document, including their own general purchasing conditions. The act of purchase implies acceptance of these general terms and conditions of sale.
